Terms of Use

Welcome to SirSync. These Terms of Use (“Terms”) govern your access to and use of sirsync.com, the SirSync Free plugin, the SirSync Pro plugin, and any related services (collectively, the “Services”). By accessing our website, creating an account, purchasing a license, or using SirSync, you agree to these Terms. If you do not agree to these Terms, please do not use SirSync.

Eligibility

You must be at least 13 years old to use SirSync. If you are using SirSync on behalf of a company or organization, you represent that you have authority to bind that organization to these Terms.

Accounts

Some features require a SirSync account. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Keeping your account information accurate and up to date.

You may delete your account at any time through your account dashboard.

Licensing

SirSync Free is available under the GNU General Public License (GPL). SirSync Pro requires a valid license for advanced features. An active Pro license is required to access Pro functionality. When a license expires:

• Previously synchronized content remains on your websites.
• SirSync Pro features are disabled.
• Free features remain available.

License Plans

SirSync licenses are based on connected site pairs. Current plans include:

• Solo – One connected site pair
• Standard – Three connected site pairs
• Agency – Ten connected site pairs

A connected site pair typically consists of two WordPress installations, such as a staging website and a production website. Agency licenses may be used across multiple client websites within the licensed site pair limit. Customers may deactivate existing site pairs and activate new ones through their account dashboard.

Permitted Use

You may:

• Install SirSync on websites covered by your license.
• Use SirSync for personal, commercial, or client projects.
• Deploy content between connected websites.
• Use the Free plugin in accordance with the GPL license.

Prohibited Use

You may not:

• Circumvent or bypass license validation.
• Modify or remove licensing mechanisms.
• Reverse engineer license validation or activation systems.
• Share, resell, sublicense, or distribute SirSync Pro.
• Misrepresent ownership of SirSync.
• Use SirSync in violation of applicable laws.

Attempts to bypass licensing or abuse the licensing system may result in immediate license termination.

Updates

Active Pro licenses receive access to plugin updates during the subscription period. SirSync may discontinue support for older versions of WordPress, PHP, or third-party software as technology evolves.

Renewals

SirSync Pro licenses renew automatically unless canceled. Customers may cancel automatic renewal at any time through their account. Canceling renewal does not immediately deactivate the license. Your license remains active until the current subscription period expires.

Refund Policy

SirSync offers a 30-day money-back guarantee for initial Pro license purchases. Refunds:

• Apply only to the initial purchase.
• Do not apply to renewals.
• Do not apply to license upgrades.
• Are limited to one refund per purchase.

Eligible refunds may be requested directly from your customer account. Once a refund is processed:

• The associated license is deactivated.
• Pro features become unavailable.
• Previously synchronized content remains on your websites.

Customer Responsibilities

You are responsible for:

• Maintaining backups of your websites.
• Testing deployments before using them in production.
• Verifying compatibility with your themes and plugins.
• Ensuring your hosting environment meets plugin requirements.

SirSync is a deployment tool. You remain responsible for the websites you manage.

Compatibility

SirSync is designed for WordPress and supports numerous themes, plugins, and page builders. However, we do not guarantee compatibility with every:

• Theme
• Plugin
• Hosting provider
• Server configuration
• Third-party integration

Disclaimer of Warranties

SirSync is provided “as is” and “as available.” To the fullest extent permitted by law, SirSync disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee:

• Error-free operation
• Continuous availability
• Compatibility with every environment
• That deployments will always complete successfully
• That use of SirSync will prevent data loss

Limitation of Liability

To the fullest extent permitted by law, SirSync shall not be liable for:

• Lost profits
• Lost revenue
• Lost business opportunities
• Data loss
• Website downtime
• Business interruption
• Indirect, incidental, special, consequential, or punitive damages

Our total liability for any claim arising from SirSync shall not exceed the amount you paid for your license during the twelve (12) months immediately preceding the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless SirSync from any claims, damages, liabilities, costs, or expenses arising from:

• Your use of SirSync.
• Your websites or website content.
• Your violation of these Terms.
• Your violation of applicable laws or the rights of another party.

Suspension and Termination

We reserve the right to suspend or terminate licenses or accounts that engage in:

• Fraud
• Chargebacks
• License abuse
• Circumvention of licensing
• Unauthorized redistribution
• Security attacks
• Violations of these Terms

Termination does not relieve you of any payment obligations already incurred.

Pricing

We may modify pricing or license limits in the future. Existing customers will receive reasonable advance notice before changes affect renewals. Our goal is to provide at least six (6) months’ notice whenever practical.

Changes to SirSync

We may:

• Add or remove features.
• Improve existing functionality.
• Modify supported integrations.
• Retire older functionality.
• Change system requirements.

Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles. Any legal action relating to these Terms shall be brought in the appropriate state or federal courts located within Washington.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the complete agreement between you and SirSync regarding use of our website and software.
